4.1 Website Updates & Site Maintenance
These are charged at our standard rate per hour (or part thereof) unless otherwise agreed. If you want to introduce new material in the form of extra pages, additional functions, or more information than is already available on your site, this must be paid for as a new job or hours taken from a prepaid package if you have this account with us.
4.2 Website Hosting & Email Accounts Hosting
Hosting for websites is charged in billing cycles of monthly, semi annually, annually, and bi-annually, and is subject to the requirement of the website for optimal performance. No clients or third parties will be granted FTP (File Transfer Protocol) access to our servers or any of our affiliates. One email account is provided, all additional email addresses will be forwarded to this or another email address which must be provided by the client.
Doodle Pod take no responsibility for any loss of business through non retrieval of emails, bounced messages or undelivered electronic mail. Doodle Pod take no responsibility for the content of emails including attachments and viruses.
Cancellation of any website will result in the withdrawal of the hosting package after 48 hours. All hosting packages are non-refundable.
Any non payments by the invoice due date will result in your hosting package being suspended and your sites and emails will not be accessible until the full payment has been made.
Clients must cancel their renewal in writing within this notice period, otherwise all charges will become payable and cancellation will NOT be accepted after this date, as monies will have been paid by Doodle Pod on the client’s behalf.
4.3 Domain Names
Domain name of the client’s choice (subject to availability) can be provided as part of our hosting package by Doodle Pod. This cannot be a domain name already registered with another provider, but must be an additional one in such cases. Delay in websites going live because of administrative issues will not result in a delay in the site going live on the domain name that we have purchased on your behalf. Once the site is live on the domain name, all outstanding payment is due. It is not Doodle Pod’s responsibility if there is a delay in the transfer of a domain name held with another provider, and this will not be accepted as a reason to delay payment in full of all outstanding monies.
4.4 Registering A Domain Name
The client agrees that all domain names carry a minimum of twelve or twenty-four months contractual bond on payment of fees, agreed by both parties.
The client agrees that all domain names are registered under the property of Doodle Pod until all contractual fees have been paid in full. On full payment the ownership of the domains will become the property of the client.
The client agrees that Doodle Pod are not held accountable for errors made on the part of the naming authorities/registration agents.
The client acknowledges that they cannot cancel any domain names once registered. On completion of payment, ownership of the domain names will be granted to the client.
The client understands that on completion of the contract, there is a hosting fee paid annually. If this fee, or any other fees are not received by Doodle Pod, the client understands that they may have their service suspended until payment has been made in full.
In the event of the domain name becoming unavailable during the registration and authorisation period, Doodle Pod will propose a new domain name for registration. The new domain name will not affect the present contractual agreements made and the client agrees that they are still subject to the same fees and charges.
4.5 Renewing A Domain Name
Doodle Pod assures the client that the best endeavours will be made to renew all domain names automatically after the initial registration period; however the client acknowledges that Doodle Pod will not be held accountable for the failure to do so.
The client agrees that prior to the renewal of any domain names, the annual renewal fee will be made payable to Doodle Pod.
The client understands that they will be informed about the renewal date a minimum 30 days in advance by writing or by email.
The E-Commerce and Website / CMS Service’s will renew domain names automatically unless requested not to by the client no later than 30 days before the renewal date.
The client agrees that neglect to pay any annual or outstanding fees will defer the registration / renewal of any domain names. This action will not yield any refunds.
The client agrees that they are to provide 30 days notice before the cancellation of any domain names. Neglect to provide this notice will result in the continuous process of the domain re-registration and consequent payment to take place.
The client understands that Doodle Pod are not responsible for any materials lost due to clients neglect to pay renewal domain registration.
As stated above, should the domain become ineffective, Doodle Pod shall provide and register a new domain name, with no refunds given.
Clients may transfer any domain names to a different Internet Service Provider (ISP) if they have provided at least 60 days notice before the next renewal payment and if their account has been settled. The client agrees that neglect to provide this notice will result in the payment of the renewal fee and a release fee.
4.6 Transferring A Domain Name
The client acknowledges that should they request Doodle Pod to host an existing domain name, they are fully responsible for the transfer to the server on the day or after the start of any agreements made are responsible for any fees paid to other parties involved in connection to the transfer. In order to affect the transfer the client shall request his/her existing ISP or any other relevant third party:-

a) in the case of UK Top Level Domains (TLD’s) to modify the Internet Protocol Server (IPS) Tag as required by Doodle Pod.

b) in the case of international TLD’s to replace the name servers, admin, technical and billing contact with the relevant details received from Doodle Pod.

c) Once the agreement has been canceled or terminated, the client has the right to transfer any domain names to a third party server. The transfer is dependent on all fees being paid in full in accordance to our pricing. All domain names cannot be permitted transfer if requested within 60 days of the renewal date.

d) The client acknowledges that Doodle Pod will not be held accountable for any obstructions in the transfer of the domain name by any third parties and that all fees should be paid according to the agreement signed.

e) The client acknowledges that Doodle Pod has the capability to hinder the release of any domain names, should the client be in breach of any agreements or payments, or if the contractual period has not yet expired and / or met.

f) The client agrees that they are fully responsible for the transfer of the website. Doodle Pod will not be held accountable for the transfer of any existing sites hosted within the appropriate domain names.

g) The client acknowledges that there may be a release fee or full payment of contract when submitting transfer request form. This is sometimes demanded by an ISP and is not the responsibility of Doodle Pod.

h) The client agrees that should an ISP deny the release of a domain name, Doodle Pod are not held accountable and are not permitted to interfere with the ordeal. Should Doodle Pod choose to intervene, the client understands that there will be a domain name handling fee. This fee is not refundable should the transfer still be unsuccessful.

i) The client agrees that services affected by the unsuccessful transfer will not be refunded. Should this occur, Doodle Pod will offer a .co.uk domain name to replace the unsuccessful transfer of the previous domain name.

j) Domain name transfers, occurring within 2 months of the renewal date, will take longer than initial transfer requests.

k) All transferred domain names will be registered to Doodle Pod until all agreed fees have been paid in full. The domain name may be transferred to the client, upon request, once all contractual fees and duties have been completed.
Should the client request that a domain name purchased by Doodle Pod on their behalf be transferred to another host, a release fee of £10 will be charged. Website hosting will be renewed automatically as part of the initial contract, but a notice period of not less than 14 days will be given at the time invoicing.
4.7 Systems
Any systems, including eCommerce, bespoke systems and Content Management Systems (CMS), provided to the client remain the intellectual property of Doodle Pod and as such no access is given to the source code or database. Systems cannot be transferred away from our provided hosting solution. Doodle Pod websites are built on the Linux or Coldfusion platforms and may not work on Windows servers or other non-Linux, Coldfusion systems.
4.8 E-commerce/CMS
E-commerce/CMS systems will be provided as an empty shop/site, and training will be given to the client(s) on using the system. A delay in the client populating the e-shop/site will not be accepted as a reason for delayed payment as, once it is ready to be populated and training has been given, Doodle Pod’s job is done. Doodle Pod offers a service to populate the client’s shop site/CMS on their behalf, and prices are available on request for this service. Additional training and support packages are available, and again the prices for these services are available on request.
4.9 Warranty
Doodle Pod guarantees all of its websites/bespoke software solutions provided to clients insofar as any faults or bugs will be rectified within a reasonable period of time so as not to interrupt the service provided by clients to their clients / users for an unacceptable time. Any software provided by Doodle Pod proving to be faulty or defective will be repaired/replaced free of charge to the working standard equivalent to launch.
The Client acknowledges that it is the Client’s responsibility to ensure that the facilities and functions of the Licensed Materials meet their requirements.
If a problem is found upon investigation not to be Doodle Pod’s responsibility, Doodle Pod may charge the Client immediately for all reasonable costs and expenses incurred by Doodle Pod in the course of or in consequence of such investigation.
4.10 Website Approval
Once a client has agreed the look and feel proof for the website and instructed Doodle Pod to proceed to build, any subsequent changes in style or design requested by the client will be charged for at the appropriate hourly rate.
Once a complete website, or changes to a website are made live on the website on the clients instruction, it is deemed that the site and / or the content of the site have been approved and the work is therefore completed.
Clients have a period of 14 days in which to revert back any further changes and corrections after which Doodle Pod reserve the right to make additional charges for further work.
4.11 Exceptions (Web)
We accept that certain details regarding your business, such as telephone numbers and email addresses, sometimes change, and that the details placed in a proof are liable to change. To this end we will amend smaller details such as these as part of our construction package. This policy applies throughout your contract with Doodle Pod: Larger changes, such as the creation of a new page or introduction of a new feature on your site, or the sourcing / changing of images are not covered by this policy and must be paid for.
4.12 Payment Terms (Web)
When we have finished building your site, we will put it live on our own server under a temporary name which we will give you. After we have informed you of the site’s location on our server, you must review the site and ask for any amendments to be made within two weeks. The site can be kept live for a longer period if you specifically request this.
We will put the site live on its own domain name, you are not permitted to point your own domain name to the test site on the Doodle Pod servers. If this is found to be the case, we reserve the right to remove the site from our server.
